Enrolled CS/HB 531 - [passed, Enrolled] Approved, Chapter No. 2008-77
Effective July 1, 2008, this legislation authorizes members of the Special Risk Class who have earned service in another membership class as a medical examiner or a law enforcement agency employee in a forensic discipline to purchase additional retirement credit to upgrade such service to Special Risk Class service; authorizes the employer to purchase such additional credit on behalf of the employee. Effective July 1, 2008, this legislation expands the forfeitable crimes for publicly funded pensions to include specified unlawful sexual acts with certain minors. Back to top

Enrolled HB 5063 - [passed, Enrolled] Approved, Chapter No. 2008-139
Effective July 1, 2008, this legislation revises the payroll contribution rates for the membership classes of the Florida Retirement System for the state fiscal years effective July 1, 2008, and July 1, 2009; clarifies that the term "compensation" for purposes of the benefit retirement program or the PEORP of the FRS does not include fees or salary payments made from a faculty practice plan authorized by the Board of Governors of the State University System for clinical faculty at a college of medicine in a state university; creates a one-year window during calendar year 2009 for FRS Pension Plan members to buy credit under the Pension Plan for their former CCORP and SUSORP participation. Effective July 1, 2008, this legislation provide for interim partial distributions during dissolution actions; provides for effect on final distributions; conforms provisions to the abolition of special equity; provides a presumption concerning certain personal property acquired during the marriage; specifies the burden of proof necessary to overcome the gift presumption; abolishes special equity; provides for claims formerly identified as special equity. Summary of Proposed House Bills

HB 27 - [Died in H Committee]
This bill by Representative Davis would have revised provisions relating to the board of trustees of the firefighters' pension trust fund and the municipal police officers' retirement trust fund; clarified the boundaries of a special fire control district; required notice to the Division of Retirement of the Department of Management Services of certain interlocal agreements; authorized the levy of taxes by municipal ordinance. This bill by Representative Adams would have provided that beginning July 1, 2009, no public employers shall enter into contracts for the physical performance of services within the state with contractors not registered and participating in a federal work authorization program; required state agencies and political subdivisions to verify the lawful presence in the United States of natural persons 18 years of age or older who have applied for state, local, or federal public benefits. CS/HB 171 - [Died in H Council]
This substitute bill by Representative Hooper would have authorized the terms of office for the board of trustees of the firefighters' pension trust fund and the municipal police officers' retirement trust fund to be revised under certain circumstances; increased the percentage of assets of such trust funds that the board may invest in foreign securities; provided guidelines for the adjustment of firefighter and police officer member contribution rates. This bill by Representative Flores would have authorized law enforcement or correctional officers who have earned creditable service in the Regular Class of the FRS between July 1, 1978, and June 30, 1984, while attending a certified training academy or other certified training facility approved by the employer for certification, to purchase such service in order to upgrade prior service to Special Risk Class. HB 389 - [Died in H Council]
This bill by Representative Precourt would have created the "Adam Pierce Act" to create a qualifying injury standard for a Special Risk Class member. The injured employee who has reached maximum medical improvement after an in-the-line-of duty qualifying injury as certified by two physicians would have retained Special Risk Class membership for as long as the member is employed by the same employer at the time of injury.Coverage under this provision would have been exempted from Special Risk Administrative Support Class membership. This bill by Representative Hooper would have provided that Special Risk Class members including, but not limited to, law enforcement officers, firefighters, and emergency medical technicians may purchase additional retirement credit for past service at a three percent Special Risk Class accrual value and would have provided that effective July 1, 2008, the contribution rate that applies to the Special Risk Class of the defined benefit program would have been increased by 0.07 percentage points. This substitute bill by Representative Heller would have created a one-year window during calendar year 2009 for FRS Pension Plan members to buy credit under the Pension Plan for their former CCORP and SUSORP participation; required funds to be transferred from their CCORP or SUSORP account, as applicable, and other employee funds as needed to pay the actuarial accrued liability of their CCORP or SUSORP participation. This substitute bill by Representative Nelson would have required lesser amount of five percent of annual contribution or ten percent of the exposure of the Hurricane Catastrophe Fund to be distributed to the Florida Hurricane Catastrophe Fund; provided criteria for payment of interest to the FRS Trust Fund on distributed contributions and deferral of interest payments but no specific mechanism for repayment of distributed retirement contributions. This bill by Representative Gardiner would have redefined "compensation" to include supplementary payments made to firefighters, paramedics, or EMTs for successful completion of employer-approved educational training or for additional job-related duties and responsibilities; redefined "average final compensation" with respect to members of the Special Risk Class as the average of the three highest fiscal years of compensation for creditable service. This bill by Representative Chestnut would have expanded the Special Risk Class to include persons with 75 percent of their time spent in inmate contact who are employed by the state and work in certain facilities or settings; provided that any member of the FRS who is employed by the state may seek an SRC review of his or her eligibility for the Special Risk Class. SB 106 - [Died in S Committee]
This bill by Senator Fasano would have authorized law enforcement or correctional officers who have earned creditable service in the Regular Class of the FRS between July 1, 1978, and June 30, 1984, while attending a certified training academy or other certified training facility approved by the employer for certification, to purchase such service in order to upgrade prior service to Special Risk Class. This bill by Senator Wise would have revised provisions relating to the board of trustees of the firefighters' pension trust fund and the municipal police officers trust fund; defined "firefighter" to clarify that certified supervisory and command personnel are covered by the firefighter pension plans and that part-time and auxiliary employees are not included in these plans; described the boundaries of a special fire control district. This bill by Senator Wise would have provided for the extension of Deferred Retirement Option Program (DROP) beyond 60 months to up to 96 calendar months for certain charter school instructional personnel in grades prekindergarten through 12; provided that eligibility for participation requires authorization from the governing board of the school; authorized charter school instructional personnel employed in grades prekindergarten through 12 to participate in the DROP extension. This bill by Senator Aronberg would have provided that a municipality that has entered into an interlocal agreement to provide police protection services to another incorporated municipality, in its entirety, is eligible to receive the premium taxes reported for the other municipality if it notifies the Department of Management Services Division of Retirement, and for as long as the interlocal agreement is in effect. This bill by Senator Fasano would have changed the name of the Public Employee Optional Retirement Program to the Public Employee Retirement Investment Program; limited the option of enrolling in the State Retirement System's defined benefit program or defined contribution program to public employees employed prior to January 1, 2009; required public employees employed on or after such date to enroll in the defined contribution program. This substitute bill by Senator Deutch would have expanded the definition of correctional officer to include certified correction officers who are employed by the state, any political subdivision of the state, or a private entity providing this service for public at a secure facility for sexually violent predators under s. 394.9221, F.S., or as institutional security personnel at a forensic facility under s. 916.1091(2), F.S. This substitute bill by Senator Jones would have authorized the terms of office for the board of trustees of the firefighters' pension trust fund and the municipal police officers' retirement trust fund to be revised under certain circumstances; authorized plan administrators to withhold funds to pay for premiums for accident, health, and long-term care insurance for retirees and retiree's spouses and dependents; provided guidelines for adjustment of member contribution rates. This bill by Senator Wise would have expanded the group eligible for up to 36 months of extended DROP participation to include prekindergarten instructional personnel if funded through the Florida Educational Finance Program, school-based district school board administrators, and district-based school board administrators if in an area of board-certified critical shortage.
