ACCIDENTAL DEATH AND DISMEMBERMENT

COVERAGE

This insurance is purchased and administered by the Department of Management Services, Division of State Purchasing. The outline of coverage shown below is provided as an overview; please refer to the insurance policy for specific information. Covered Personnel

"Covered Personnel" means all state law enforcement officers including: correctional officers, correctional probation officers, firefighters, Florida Highway Patrol auxiliary officers, state attorney investigators, public defender investigators, members of bomb disposal units, full-time officers or employees of the State certified pursuant to Chapter 943, F.S., whose duties require serving processes or attending to the terms of circuit or county court as bailiffs, and members of organized militias while in active military service of the State, as provided in Sections 112.18, 112.19, 112.191, 250.34, 321.24, and 943.10 of the Florida Statutes.

Insurance Coverage and Limits

A. Current Law Enforcement and Firefighter Death Benefits*

1. $59,695 - Paid to the designated beneficiary, family member, or estate when a Covered Personnel, while engaged in the performance of the Covered Personnel's duties, is accidentally killed or receives accidental bodily injury which results in the loss of the Covered Personnel's life, provided that such killing is not the result of suicide and that such bodily injury is not intentionally self-inflicted.

2. $59,695 - Paid to the designated beneficiary, family member, or estate when a Covered Personnel, while engaged in the performance of the Covered Personnel's duties, is accidentally killed as specified in paragraph (A)(1) above, and the accidental death occurs as a result of the Covered Personnel's response to fresh pursuit or to the Covered Personnel's response to what is reasonably believed to be an emergency. This sum is in addition to any sum provided for in paragraph (A)(1) above.

3. $179,085 - Paid to the designated beneficiary, family member, or estate when a Covered Personnel, while engaged in the performance of the Covered Personnel's duties, is unlawfully and intentionally killed or dies as a result of such unlawful and intentional act.

*Sums are adjusted annually in accordance with 112.19(j) and 112.191(i) of the Florida Statutes. The sums listed above represent the amounts approved for 2008/2009.

B. Dismemberment & Total Disability - Payable to Florida Highway Patrol Auxiliary for the following categories:

  • Total Disability (weekly indemnity) - $300
    • Indemnity Period List - 104 Weeks

Other Insurance Conditions

  • All benefit payments are in addition to any workers' compensation or pension benefits, and are exempt from the claims and demands of creditors of such Covered Personnel.
  • All Covered Personnel killed in the line of duty as a result of an act of violence inflicted by another person while the officer is engaged in the performance of law enforcement duties, or as a result of an assault against the officer under riot conditions, a sum of $ 1,000 shall be given toward the funeral and burial expenses. Such benefits are in addition to any other benefits which Covered Personnel beneficiaries and dependents are entitled to under the provisions of the Workers' Compensation Law or any other state or federal statutes.
  • The applicable policy limits do not, upon the occurrence of any covered loss, reduce the policy limit. No policy aggregate applies.
  • Deductibles do not apply to this policy.
  • Coverage applies on a world-wide basis and consists of all forms of travel related to duties, including travel to and from the Covered Personnel's residence.
  • No aircraft exclusions or limitations will be accepted.
  • No watercraft exclusions or limitations will be accepted.

Coverage Categories & Annual Rates Per Covered Personnel

The following categories provide an explanation of the position-descriptions for each Covered Personnel. This information is used by the insurance company for rating purposes.

A. Law Enforcement ($24.08): Employees of the state who are vested with the authority to bear arms and make arrests and whose primary responsibility is the prevention and detection of crime or the enforcement of the penal, criminal, traffic, boating, or highway laws of the State. Duties may include highway patrol and marine patrol.

B. Law Enforcement Officer, Investigator, or Inspector ($12.13): Employees of the state who are vested with the authority to bear arms and make arrests and whose primary responsibility is the prevention and detection of crime or the enforcement of the penal, criminal, traffic, boating, or highway laws of the State. Duties may include wildlife and environmental protection and enforcement. Covered occupations include: investigators, inspectors, state park patrol officers, and public defender investigators.

C. Pilots ($54.83): Employees of the state who are vested with the authority to bear arms and make arrests; and whose primary responsibility is the prevention and detection of crime or the enforcement of the penal, criminal laws of the state. This classification includes employees who are certified by the Federal Aviation Agency and have been approved as state pilots.

D. Reserve, Volunteer, or Auxiliary Law Enforcement Officers ($12.07): Individuals appointed without compensation, who aid or assist a full-time or part-time law enforcement officers and who, while under the direct supervision of full-time or part-time law enforcement officers, have the authority to arrest and perform law enforcement functions.

E. Patrol Officers ($12.93): Employees of the state who are vested with the authority to bear arms and make arrests and whose primary responsibility is the prevention and detection of crime or the enforcement of the penal, criminal, traffic, or highway laws of the State while on the premises of a school or university.

F. Firefighter ($23.76): Employees of the state whose primary responsibility is the prevention and extinguishment of fires, the protection of life and property therefrom, the enforcement of state fire prevention codes, and the enforcement of any law pertaining to the prevention and control of fires.

G. Militia ($2/day): Active military service of the state.

H. Certified Correctional Officers, Security Officers, Bailiffs, or Process Servers ($12.07): Employees of the state whose primary responsibility is the protection of personnel, visitors, and facilities or the supervision, protection, care, custody, control, or investigation of inmates within a correctional institution or of persons who are charged with, suspected of committing, or have been convicted of a crime.

I. Trainers ($5.94): Employees of the state who are vested with authority to bear arms and make arrests and whose primary responsibility is law enforcement training or other clerical functions.
