MFMP Vendor Terms of Use
The Department of Management Services recently revised the Terms of Use (TOU) for MyFloridaMarketPlace vendors. The new TOU went into effect April 29, 2009. A complete copy of the TOU is available at http://dms.myflorida.com/mfmp under the vendor bulletin board or by clicking on the links below.
What's Different?
- The previous TOU included three separate agreements between the vendor, the State of Florida and the State's Service Providers; these are now combined into a single agreement
- The previous TOU also stipulated that disputes against two of the three agreements would be heard in California, not Florida. The new TOU stipulates all disputes will be heard in Florida
- Overall, the new TOU are simpler and more vendor-friendly
If a vendor decides to reject or dispute the new TOU, they will no longer be a registered supplier on MyFloridaMarketPlace and, therefore not allowed to receive purchase orders through the Service.
Frequently Asked Questions (FAQs)
What do I do with this information?
No action is necessary on your part to accept the new TOUs since you are already a registered vendor. You do not have to re-register or accept the new TOU online.
Do the new TOU have any effect on existing State Term Contracts?
No. The revised TOU do not effect the terms and conditions of existing State Term Contracts.
Do the new TOU affect eInvoicing (Electronic Invoicing) requirements for vendors?
The new TOU eInvoicing language was not revised from the original TOU. See below for eInvoicing excerpt:
What if I don't agree with the new TOU?
Note: DMS simply condensed three separate TOUs into a single agreement and stipulated that disputes regarding the system be heard in Florida court; the actual contractual content and language between each individual vendor and the State did not change.
In the case that a registered vendor still decides to reject or dispute the new TOU, they must file a request to inactivate their account with the Vendor Help Customer Service Desk at VendorHelp@MyFloridaMarketPlace.com.
