State Agency and Local Government use of all GSA Schedules in Response to Public Health Emergencies

Purchasing Directors,

Effective August 17, 2009, state, local, territorial, and tribal governments may access all Federal Supply Schedules as authorized users for goods and services when expending Federal grant funds in response to Public Health Emergencies (PHE) declared by the Secretary of Health and Human Services under section 319 of the Public Health Services Act, codified at 42 U.S.C. ยง 247d. The attached document provides more details about this program.

While the use of GSA Schedules not previously subject to cooperative purchasing, in this case, specific to expending Federal grant funds in response to Public Health Emergencies, the Division of State Purchasing encourages the use of the Federal Acquisition Services, General Services Administration Schedules contracts in accordance with the guidance provided in State Purchasing Memoranda numbers 1 and 2 for purchasing Technology on Schedule 70 or for the purchase of Total Solutions for Law Enforcement, Security, Facility Management Systems, Fire, Rescue, Special Purpose Clothing, Marine Craft and Emergency/Disaster Response equipment on Schedule 84. Please refer to these State Purchasing memoranda for specific procedures for purchases pursuant to Federal grant funds in response to public health emergencies, but in general, the use of GSA Schedules should only be used for commodities and services that are not currently available on State Term Contract.
