Vendor Bid System Information - Bidder Acknowledgement Forms
This page replaces the list of Bidder Acknowledgement Forms previously listed on the VBS website. Those forms were incorporated by reference in the Florida Administrative Code, in rule 60A-1.002.
As a result of significant rulemaking in 2004, the forms were replaced by two documents: PUR 1000, General Contract Conditions and PUR 1001, Instructions to Respondents. These documents are available on State Purchasing's Forms page.
PUR 1000 contains the general contract terms for all contracts issued by state agencies. The amended rules require agencies to include this form in their solicitations, but it also allows agencies the flexibility to attach "Special Conditions" that provide more terms or even supercede the PUR form, if necessary.

An example: Paragraph 34 of PUR 1000 requires a Contractor to maintain "commercial insurance of such a type and with such terms and limits as may be reasonably associated with the Contract." This may be a reasonable paragraph on it own, but an agency is free to attach Special Conditions that specify more detailed insurance requirements. |
PUR 1001 contains the basic rules of the solicitation. It tells interested parties how they can submit a responsive and responsible bid. Special Instructions will always need to be added to this document; rule 60A-1.002, F.A.C. requires that the agency attach "additional materials specific to each particular solicitation, including but not limited to contact information, a solicitation timeline, a location for the public opening, evaluation criteria, required information regarding renewal of the contract, and any other necessary information."
Until such time as agencies begin using the online system for sourcing, agencies may also supercede the terms in PUR 1001 that require electronic submission of bids.

For example, in the Special Conditions an agency still using paper bid processes might say: Paragraph 3 of PUR 1001 is hereby deleted. Bidders shall submit the original bid and one copy in a sealed envelope, which shall indicate (Agency's) address, the bid number, and date and time of the bid opening. Bids not submitted in accordance with these solicitation documents shall be rejected. Each bidder is responsible for ensuring that its bid is delivered at the proper time and to the proper place. (Agency) shall not consider late bids. BIDS MUST BE RECEIVED AT (ADDRESS) , AT OR BEFORE (TIME AND DATE) . |
